Obama administration clears path for Supreme Court to rule on health care mandate

[JURIST] The Obama administration on Monday declined to seek en banc review by the full US Court of Appeals for the Eleventh Circuit [official websites] of its August decision striking down the individual mandate provision [JURIST report] of the health care reform law [JURIST backgrounder], clearing the path for an appeal to the US Supreme Court [official website]. The decision could mean that the Supreme Court will hear the case during its 2011 term and that a ruling could come as early as June. The court is expected to agree to hear the case because there is a circuit split on the issue. The US Court of Appeals for the Sixth Circuit [official website] upheld the law in June, and that ruling was appealed [JURIST reports] to the Supreme Court by the Thomas More Law Center (TMLC) [advocacy website]. JURIST Guest Columnist Steven Schwinn of the John Marshall Law School in Chicago recently argued that the Eleventh Circuit ignored the text, history and jurisprudence of the Constitution in its recent health care ruling, which will likely not be adopted by the Supreme Court [JURIST op-ed] given recent rulings on congressional Commerce Clause authority.

Other courts have also weighed in on the constitutionality of the individual mandate provision. Earlier this month, a judge for the US District Court for the Middle District of Pennsylvania [official website] ruled that the individual mandate is unconstitutional [JURIST report]. Also in September, the US Court of Appeals for the Fourth Circuit [official website] dismissed two lawsuits [JURIST report] challenging the mandate's constitutionality. In Virginia v. Sebelius, the court held that Virginia lacked standing to sue and vacated the judgment of the district court [JURIST report], remanding the case with instructions to dismiss the suit for lack of subject-matter jurisdiction. In Liberty University v. Geithner, the court ruled that the suit was filed prematurely, also vacating the lower court ruling [JURIST report], which had declared the act constitutional.

Dr Zernik’s affidavit opined fraud by the US courts in the Northern District of Georgia and the District of Columbia in cases involving William Windsor. Widespread fraud and corruption is enabled through PACER and CM/ECF, the electronic public access and case management systems of the US courts.

Los Angeles, August 18 – Joseph Zernik, PhD, of Human Rights Alert (NGO), filed an affidavit in support of the testimony of Mr William Windsor before a Federal Grand Jury in Atlanta, Georgia, pertaining to corruption of the US courts. [[i]]

Dr Zernik has gained substantial experience over the past decade in examining electronic records of the California and US courts:

A report, which he authored, was reviewed by the professional staff of the Human Rights Council of the United Nations, as part of the first ever, 2010 Universal Periodic Review (UPR) of Human Rights in the United States. The report was incorporated into the official UPR Staff Report with a note referring to “corruption of the courts and the legal profession and discrimination by law enforcement in California”. [[ii]]
A scholarly paper, which he authored on the subject of fraud in the electronic records of the US courts, was peer-reviewed and published in a computer science journal with an editorial board listing scholars from six (6) European nations and Canada. [[iii]]
An abstract on the subject of fraud in the electronic records of the US courts, which he authored, was peer-reviewed and published by the 16th World Criminology Congress.
The same papers were peer-reviewed and selected for presentations in an international computer science conference in Europe and the 16th World Criminology Congress in Japan. [[iv]]
His opinions in such matters were also re-affirmed by opinion letters of well-recognized fraud experts and a computer science scholar, including, but not limited to:
- James Wedick, an FBI-veteran, who was decorated by the US Congress, by FBI Director, and by US Attorney General for his achievements in law enforcement, [[v]] and
- Professor Eliyahu Shamir, a well-recognized computer science expert, who made seminal contributions to computer science in the field of language analysis (co-author of the “Pumping Lemma”). [[vi]]

In his affidavit, Dr Zernik opined regarding the records in two specific cases involving Mr Windsor:

Maid of the Mist Corporation et al v Alcatraz Media, LLC, et al (1:09-Cv-01543) in the US Court, Northern District of Georgia. [[vii]]
Windsor v Evans et al (1:10-cv-00197) in the US Court, District of Columbia. [[viii]]

In both cases, Dr Zernik opined fraud by the respective US district courts on Mr Windsor.
The nature of the fraud was the conduct of simulated litigation. [[ix]]

Dr Zernik further opined that PACER (the electronic system for public access to court electronic records) and CM/ECF (the electronic system for case management and electronic case filing), which were implemented by the Administrative Office of the US Courts, enable the routine conduct of simulated litigation of cases before the US courts from coast to coast.

In previous publications, Dr Zernik opined that the introduction of such fraudulent electronic records systems in the US courts undermines Human Rights and banking regulation, and that corruption of the US courts was tightly linked to the current economic crisis. [[x]]

Minnesota's legislative auditor is releasing a report on the state's program for civil commitment of sex offenders.
Minnesota's program has grown to more than 600 patients and adds about 50 per year. Defendant-Appellant James Bunchan was convicted by a jury for use of a facility of interstate commerce in the commission of murder-for-hire and solicitation to commit a crime of violence. The case arose from Bunchan's efforts to hire someone to kill the people whom he expected to testify against him in a pending federal fraud prosecution. He now appeals his convictions and sentence, arguing that the district court constructively amended the indictment when it instructed the jury as to the solicitation offense, improperly instructed the jury on nullification, and imposed an unreasonable sentence of 300 months. We reject Bunchan's claims and affirm the district court.

On August 3, 2010, the Center for Constitutional Rights and the American Civil Liberties Union filed a lawsuit against the U.S. Treasury Department and the Office of Foreign Assets Control (OFAC) to challenge the legality and constitutionality of the licensing scheme that requires them to obtain a license in order to file a lawsuit concerning the government’s asserted authority to carry out targeted killings of individuals, including U.S. citizens, far from any battlefield.

National Public Radio’s dismissal of Juan Williams is a powerful indictment of NPR’s practices and corporate culture. Small wonder voices are once again calling for the federal government to defund NPR—which gets 16% of its budget from tax payers. The Heritage Foundation has long called for such defunding. A veteran journalist, Williams is a liberal with whom I disagree more often than not. His integrity, his bravery, his refusal to be intimidated by peer pressure cannot be doubted, however. He has written thoughtful books on the civil rights movement and also dared speak to the African-American community about how dysfunctional family structures and devaluation of education and morality can produce and perpetuate crime and poverty. His commitment to improving opportunities for minorities even led him to agree to narrate a Heritage Foundation documentary on the demise of the DC Opportunity Scholarship Program.

Now, because of the obvious mishandling of this homosexual ticking time bomb, it appears that the United States, its soldiers, and relations with countries in the region will pay the price. Lives—and a war on terrorism in Afghanistan—could be lost.
In the scandal involving the theft and release of classified military information that could cost the lives of U.S. military personnel, the British Telegraph newspaper reported that the American soldier at the center of the scandal was “openly homosexual” and apparently held a grudge against the U.S. because of the military’s anti-gay policy.
In another bizarre twist, reliable reports suggest that Private First Class Bradley Manning, the U.S. Army Intelligence analyst accused of leaking the classified information to the
WikiLeaks.org
website, was not only a homosexual but was considering a sex change. Manning was arrested at the end of May and is being detained by U.S. authorities.
The Telegraph features photographs of Manning, who could face more than 50 years in prison for treasonous conduct, holding up a sign with rainbow colors demanding “equality on the battlefield” and participating in a gay pride parade.
It is apparent that Manning, based on published reports, was a public homosexual activist for at least over a year. During this time he apparently came up with the idea of downloading and releasing the classified information to WikiLeaks as a way to get back at the United States military over its policy regarding homosexuality.
Telegraph writers Heidi Blake, John Bingham and Gordon Rayner wrote that Manning had “appeared to sink into depression after a relationship break-up” and became increasingly bitter with his treatment by the Army. Linked to Treason

U.S. District Judge Susan Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally. In a lawsuit filed against Arizona, the Obama administration said the law was unconstitutional and warned that the provision would result in racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors. [Barack Obama doesn't care about 'racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors.' If he did, he would close Guantanamo Bay and Bagram prisons, stop Bush's illegal domestic spying programs, sunset the Patriot Act, and stop outsourcing. [JURIST] A judge for the US District Court for the District of Arizona [official website] on Friday granted a preliminary injunction [opinion text] against an amendment to an Arizona law [ARS § 38-651 text] regarding health benefits for the families of state employees. The amendment, added as subsection O, would remove language from the law allowing interdependent domestic partners to receive health benefits by changing the definition of "dependent" to include only married couples and their children, effective October 1, 2010. The state employees argue that the amendment violates their rights to equal protection and substantive due process and that the amendment has no rational relationship to a legitimate state interest. In his order, Judge John Sedwick granted the preliminary injunction, finding that the plaintiffs met their burden of showing that their case would be likely to succeed on the merits and that they would suffer irreparable harm without the injunction. He also found the state's arguments that the amendment served the state interest of cost savings and administrative efficiency to be "speculative at best and discriminatory at worst." Lambda Legal [official website], the organization representing the state workers, praised the judge's decision [press release]:
This injunction removes the sword that's been hanging over the heads of hundreds of state workers and their families. We're pleased Judge Sedwick has recognized that this is a matter of equal pay for equal work, and that eliminating benefits for Arizona's gay and lesbian state employees would hurt real families.
The order also denied the state's motion to dismiss the workers' equal protection claim and Arizona Governor Jan Brewer's claim of immunity. The order granted the state's motion to dismiss the workers' substantive due process claim. The injunction is set to go into effect within 10 days.
Arizona is also facing a federal lawsuit regarding its controversial new immigration law. The US Department of Justice [official website] filed suit earlier this month [JURIST report] arguing that the law violates the Supremacy Clause [text] of the US Constitution. The law criminalizes illegal immigration and allows police officers to question individuals based on "reasonable suspicion" that they are in the country illegally. The law is already being contested in a class-action lawsuit [JURIST report] led by the American Civil Liberties Union [advocacy website]. Brewer signed the legislation into law in April and the law is set to go into effect on July 29.

The Texas Department of Information Resources (DIR) warned IBM on Friday that its $863 million data center outsourcing contract with the state is in jeopardy. A seven-page "notice to cure" from Texas CIO Karen Robinson asserts that IBM has repeatedly underperformed and undelivered on the seven-year contract
signed
in 2006. The notice gives the company 30 days to fix the problems.
"IBM promised an investment in people, processes and technology to bring the benefits of data center consolidation to the state of Texas. We have had continual problems with basic service delivery and IBM has failed to deliver on their promises," said Robinson, in a statement released by the DIR Friday.
The DIR says IBM failed to deliver on the centerpiece of the agreement: moving IT operations for 27 Texas state agencies into two new consolidated data centers that would be operated by the vendor. The notice gives IBM 10 days to come up with an acceptable plan for solving the problems and 30 days to implement the fixes. If not, the state could begin proceedings to cancel the contract, which is one of the largest state government IT outsourcing deals in the nation.
IBM denied the allegations.
"IBM has fulfilled its obligations under the contract and today's action by DIR was unnecessary and unjustified," said company spokesman Jeff Tieszen. "IBM has worked in cooperation and good faith with DIR to provide benefits and improvements to all citizens of Texas. IBM very much regrets the state's action and will aggressively protect its interests going forward."

WASHINGTON – News that a discharge petition in the House of Representatives has gathered half the names necessary to force a vote repealing Obamacare has spurred an online petition campaign to rally the public to the cause.
"Who would have thought we might have a chance to repeal Obamacare – this term?" exclaimed Joseph Farah, editor and chief executive officer of WND, in response to the plan by Rep. Steve King, R-Iowa. "This movement has already gained half the support it needs in the House of Representatives. Now it's time for the public to turn up the pressure on the other half."

A man in the country illegally who committed a $27,000 identity-theft crime in Scott County was able to obtain tens of thousands of dollars in governmental medical assistance, including surgery for an inflatable penis pump.
In response to heightened concern about illegal immigration since a gang-related stabbing in Shakopee, Scott County Attorney Pat Ciliberto has been tallying known costs to taxpayers and gave this example.
“There’s no logical argument for why that should have been approved,” Ciliberto told county commissioners on Tuesday. “I don’t know how many illegal aliens are getting emergency medical assistance for such a procedure.”
It is impossible to know the full cost of illegal immigrants in Scott County receiving public assistance or going through the court system, but the burden on the jail alone is staggering.
The county’s cost for housing inmates with immigration holds has grown nearly tenfold in recent years, reaching more than $307,000 last year. The impact over the last four years totaled $843,600, which doesn’t even include medical coverage. migration

Small, rural hospitals, struggling to stay afloat financially, took another blow last week when Gov. Tim Pawlenty turned down the opportunity for Minnesota to get an early start at expanding Medicaid eligibility.
In a letter to Human Services Commissioner Cal Ludeman, the governor cited the state’s costs to enroll early, which he claims would total $430 million over the next three years to obtain $1.4 billion in federal funding.
But DFLers dispute the governor’s numbers. Using figures from the non-partisan fiscal staff, they say the enrollment would cost Minnesota $188 million on top of what it is already spending. House media staff say the difference is that Pawlenty failed to include the savings to the health care access fund, which pays for MinnesotaCare, that early enrollment would produce.
Hospitals, physicians and advocates for the poor had pushed for early enrollment, saying it would create or preserve 22,000 private-sector health care jobs and provide better access to health care for upwards of 100,000 poor Minnesotans.
The Legislature, however, gave the governor the option of opting out of early enrollment after Republicans attacked the program as “Obamacare.”
“That was absolutely silly on the state’s part,” said Al Vogt, administrator at the Cook Hospital. About half a million Minnesotans already receive health care through Medicaid and Wisconsin has provided health insurance for its poorest adults through the Medicaid program for years.
“Gov. Pawlenty may have the good graces of the Republican Party’s central core,” continued Vogt, “but he has lost support from this state.”
The next governor will have another shot at the decision to enroll early without legislative action. DFLer Margaret Anderson Kelliher has said should she win the race for governor, one of her first executive actions would be to pull in the federal money and take up the early enrollment option.
Funding shortfalls
The lack of adequate funding from both federal and state sources has been a thorn to rural hospitals for years.
“In small hospitals, such as Virginia, which has a 60 to 66 percent government pay, meaning Medicare and Medicaid, we get paid less from the government for what we do than what it costs,” said Dr. Wendell Smith, who works for the St. Mary’s Duluth Clinic health system and practices in the Virginia hospital.
Virginia Regional lost about $3 million over the last two years and more than $1 million so far this year.
Hospitals in larger cities like Duluth receive enough non-government patients to make up the losses, said Smith. Hospitals in smaller communities such as Virginia, Ely or Cook can not rely on that safeguard.
“You still have to provide the same quality. You still have to buy the same equipment. You don’t have the economy of scale on the equipment, so your overhead is more and your reimbursements are less,” Smith continued.
Nursing home dilemma
Smith’s concerns have been especially true for hospitals that also operate nursing homes. The state’s reimbursement rates for long-term care fall far short of the actual expenses, adding significantly to losses at small hospitals.
“We’ve lost $1.2 million year to date,” said Ely-Bloomenson Hospital Administrator John Fossum. “I would say at least half of that is the nursing home.”
Vogt said the Cook Nursing Home, which had reduced beds in an effort to cut costs, still loses $800,000 to $900,000 per year. The Cook-Orr Healthcare District has established a long-term care committee to examine ways to further reduce costs or increase revenue to make the nursing home come as close as it can to breaking even.
Some options being considered are the possible creation of a taxing district for the nursing home or selling the home to another provider.
“We don’t want to talk about closure, but we cannot allow the nursing home to bring the hospital under,” said Vogt.
Both Fossum and Vogt say the state has shown no interest in providing more financial support for nursing homes and with a $5 billion to $6 billion budget deficit looming, they don’t expect a significant boost in funding.
“The status quo can’t be maintained,” said Fossum. “I think the state is going to have to take a serious look at how many nursing home beds they think they need and tell everyone else to seek an assisted living option.”
Recession’s impact
Meanwhile, the recession has hit small hospitals hard as more people either lose health insurance or are saddled with prohibitively high deductibles, discouraging them from seeking medical care or making them unable to pay their bills.
“Our uncompensated care and bad debt have gone through the roof,” said Vogt, who estimates that the hospital’s uncompensated care has at least doubled.
Fossum said he has no hard data to support claims that lack of insurance or higher deductibles are keeping people from seeking medical care, but the anecdotal evidence is compelling.
“For some people, it’s a question of finances,” he said. “Do I make a house payment or do I go to the doctor?”
The Cook Hospital is doing better than many of its peers this year, said Vogt, thanks in part to a good patient volume and a levy it collects in the Cook-Orr Healthcare District. But, he added, the facility still needs to keep a close watch on its finances.
“Cook has always lived on a starvation diet,” said Vogt. “A lot of places are not used to that. But we could just as easily be on the other side of the bubble. At any given moment, hospitals can be in better or worse shape. It’s not that we’re doing anything wiser or better than the others; it’s just that our patient mix this year is helping us. It could be a different story next year.”

A college instructor who worked as a senior elections clerk for the city and county of Honolulu in 2008 is making the stunning claim Barack Obama was definitely not born in Hawaii as the White House maintains, and that a long-form, hospital-generated birth certificate for Obama does not even exist in the Aloha State.
Tim Adams, a former senior elections clerk for Honolulu, now teaches English at Western Kentucky University.
"There is no birth certificate," said Tim Adams, a graduate assistant who teaches English at Western Kentucky University in Bowling Green, Ky. "It's like an open secret. There isn't one. Everyone in the government there knows this."
Adams, who says he's a Hillary Clinton supporter who ended up voting for John McCain when Clinton lost the Democratic nomination to Obama, told WND, "I managed the absentee-ballot office. It was my job to verify the voters' identity."
He says during the 2008 campaign when the issue of Obama's constitutional eligibility first arose, the elections office was inundated with requests to verify the birthplace of the U.S. senator from Illinois.

For a head of government to visit the White House and not pose for photographers is rare. For a key ally to be left to his own devices while the President withdraws to have dinner in private was, until this week, unheard of. Yet that is how Binyamin Netanyahu was treated by President Obama on Tuesday night, according to Israeli reports on a trip viewed in Jerusalem as a humiliation.
After failing to extract a written promise of concessions on settlements, Mr Obama walked out of his meeting with Mr Netanyahu but invited him to stay at the White House, consult with advisers and “let me know if there is anything new”, a US congressman, who spoke to the Prime Minister, said.
“It was awful,” the congressman said. One Israeli newspaper called the meeting “a hazing in stages”, poisoned by such mistrust that the Israeli delegation eventually left rather than risk being eavesdropped on a White House telephone line. Another said that the Prime Minister had received “the treatment reserved for the President of Equatorial Guinea”.

" columnist James Shiffer and freelance multi-media producer McKenna Ewen have produced a new website that explores the unsolved 1945 police report of Minneapolis muckraker Arthur Kasherman.
Called "
Rubbed Out
," the project was a side job for the two men; the site includes the original police report; reproductions of Kasherman's scandal sheet, the "Public Press"; a video recapitulation; map of the dirty deed (which involved a stabbed tire and a gal with a shiner); a line-up of suspects; and Shiffer's narrative look-back.
Shiffer doesn't glorify Kasherman, who sounds more like a palooka than Pulitzer finalist; the scandal-monger sported an extortion conviction and other legal scrapes. Kasherman's prose is long on purple and short on specifics (Shiffer likens him to a blogger) but the site makes a pretty good case for the man's historical importance. Kasherman was the last of three muckrakers to be murdered in the city, and even if he was the least respected, his killing was adroitly leveraged by forces backing an insurgent candidate for mayor, Hubert Humphrey.
What's neat about this is that Shiffer, a relatively recent transplant, cares so passionately about his adopted city, and still bristles over the lazy police investigation of a shirt-tail professional relative almost seven decades later. He was smart to enlist Ewen, a "digital native" who's one of the best young journalists in town. (You can check out Ewen's appearance on last Friday's "Almanac"

Leveraging the resources of the Strib, Minneapolis Police Department, Minnesota Historical Society and the Hennepin County Library, Shiffer and Ewen have made faded times come alive, an "L.A. Confidential" for the Mill City that takes us from the digital era to a time of dames and dime-drops.

An attorney whose legal brief in a case challenging Barack Obama's eligibility revealed a Supreme Court can remove an ineligible chief executive now has released an analysis confirming that if Obama isn't eligible, he could be charged under a number of felony statutes.
And that's just on the federal level; any state charges would be in addition, as would charges against individuals who may have helped him in the commission of any of the acts, according to Gary Kreep of the United States Justice Foundation.
Kreep has been involved in several of the cases that have raised challenges to Obama's occupancy of the Oval Office, including two in California. One is on appeal in the state court system and names California Secretary of State Debra Bowen as defendant. The other, in the federal court system, is on appeal before the 9th U.S. Circuit Court of Appeals.
Both make claims on behalf of individuals and political candidates in California over Obama's presence on the 2008 election ballot.

North Dakota Gov. Thomas Moodie, removed from office when the state Supreme Court found him ineligible
WND several weeks ago reported when Kreep's legal research revealed two precedents he believes would be applicable in the Obama case. In one, state officials arbitrarily removed a candidate from an election ballot because it was not proven the candidate was qualified for office. In another, the North Dakota Supreme Court removed the sitting governor from office when it was documented he was not eligible under the state's requirements.
Now Kreep has released an analysis of the federal laws he believes could be applied should Obama ultimately be shown to be ineligible.
"If he is not eligible, he could be charged not only with these crimes, but potentially with crimes in a number of states where he falsely represented that he was qualified to run, as well as people who helped him," Kreep told WND.
Further, there could be any number of challenges to virtually anything he did as president: his nominations, his executive orders and his signing of legislation.
"This is completely uncharted territory," Kreep told WND. "It could all be challenged as invalid. There has to be a sitting president for [actions] to be valid. If he's not qualified, if he's not the president, it isn't valid." following statutes that could apply:
False Personation of Officer or Employee of the United States (18 U.S.C. § 912).

It states: "Whoever falsely assumes or pretends to be an officer or employee acting under the authority of the United States or any department, agency or officer thereof, and acts as such, or in such pretended character demands or obtains any money, paper, document, or thing of value, shall be fined under this title or imprisoned not more than three years, or both."

The USJF analysis said, "Basically this statute calls for 1) Fraudulent intent, and 2) an overt act to accomplish the inducement of one giving over a thing of value. If it were found that Barack Obama was not a natural born citizen, as required by the U.S. Constitution Art. II § 1, he will have assumed the office of president fraudulently to obtain money (among other things) by way of his annual salary. The Supreme Court has upheld convictions for False Personations in U.S. v. Lepowitch, (63 S.Ct. 914), and Lamar v. U.S., (36 S.Ct. 535)."

Conspiracy to Commit Offense or to Defraud United States (18 U.S.C. 371).

It states: "If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both. If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor."

The USJF analysis said, "As in all conspiracies, there must be two or more persons working in concert to achieve an illegal act, so the president would need a co-conspirator for this statute to apply. The state of Hawaii is being very secretive about the whereabouts or even existence of Mr. Obama's supposed birth certificate. If the officials in charge of keeping these records know of its non-existence, then they would be co-conspirators with the objective of defrauding the United States as to the citizenship status of Barack Obama. There, however, must be an 'in concert' element met, meaning that these officials are withholding the proof at the direction of Mr. Obama. Is it possible that these officials love Barack Obama so much that they are withholding these documents out of the goodness of their own hearts? Yes, possibly, however unlikely. It is reasonable to infer that the Hawaiian officials are working 'in concert' with Mr. Obama to suppress this information, since each would face both civil and criminal suits, not to mention the loss of furthering their own political goals."

Activities Affecting Armed Forces During War (18 U.S.C. 2388(a)).

It states: "(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or

"Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so—Shall be fined under this title or imprisoned not more than twenty years, or both."

The USJF analysis said: "Intent is fully at issue here; however, President Obama made it clear during his campaign that his full intent when entering office would be to scale down the conflict with Afghanistan and Iraq, eventually leading to a full withdrawal. His statements of being a natural born citizen to obtain the office of commander in chief were in effort to interfere with the attempts by the former commander in chief's attempt at engaging the enemy in these two countries, for the purpose of national security.

"In the case of Schulze v. U.S. (259 F. 189) Petitioner was convicted under this statute, and the question of intent was at issue. The court stated, 'It is true that in charging the offense it is unnecessary to allege the intent; the offense being one whose very definition necessarily includes intent. In such a case it is necessary only to aver in apt terms the acts done. The intent will be inferred. The charge is not unlike that of treason, the indictment for which needs go no further than to follow the language of the statute which defines the offense. (United States v. Greathouse, 2 Abb.U.S. 364, Fed. Cas. No. 15,254)…

"This means that intent is inferred from the act itself. Mr. Obama has already announced that the efforts in Afghanistan will be scaled back, and a full withdrawal is planned for 2011. Furthermore, the announcement of this strategy works to the aid of our enemy, who now knows to sit in caves and wait out the U.S. for only a year or so. This certainly works interrupt our operations and promote the success of our enemy."

False Statement in Application and Use of Passport (18 U.S.C. 1542).

It states: "Whoever willfully and knowingly makes any false statement in an application for passport with intent to induce or secure the issuance of a passport under the authority of the United States, either for his own use or the use of another, contrary to the laws regulating the issuance of passports or the rules prescribed pursuant to such laws; or

"Whoever willfully and knowingly uses or attempts to use, or furnishes to another for use any passport the issue of which was secured in any way by reason of any false statement—Shall be fined under this title, imprisoned not more than 25 years (if the offense was committed to facilitate an act of international terrorism (as defined in section 2331 of this title)), 20 years (if the offense was committed to facilitate a drug trafficking crime (as defined in section 929 (a) of this title)), 10 years (in the case of the first or second such offense, if the offense was not committed to facilitate such an act of international terrorism or a drug trafficking crime), or 15 years (in the case of any other offense), or both."

The USJF analysis said: "To obtain a U.S. passport one must show a valid birth certificate or some other form of identification showing U.S. citizenship. Barack Obama would have to have furnished some sort of birth certificate or other document showing he is a citizen. Of course, even if he was not a natural born citizen, he could show naturalization or some other citizenship papers. However, if these documents are spurious, then he would be guilty pursuant to the first paragraph, and to then use his illegally obtained passport, he would also be guilty under the second paragraph as well."

False Personation of Citizen of the United States (18 U.S.C. 911).

It states: "Whoever falsely and willfully represents himself to be a citizen of the United States shall be fined under this title or imprisoned not more than three years, or both."

The analysis said: "If Mr. Obama is not a natural born citizen, then he must have other proof of United States citizenship. If he has neither of these, then as acting head of state he is holding himself out to be a citizen of the United States, and is therefore liable under this section as well."

Perjury (18 U.S.C. 1621).

It states: "Whoever—(1) having taken an oath before a competent tribunal, officer, or person, in any case in which a law of the United States authorizes an oath to be administered, that he will testify, declare, depose, or certify truly, or that any written testimony, declaration, deposition, or certificate by him subscribed, is true, willfully and contrary to such oath states or subscribes any material matter which he does not believe to be true; or

"(2) in any declaration, certificate, verification, or statement under penalty of perjury as permitted under section 1746 of title 28, United States Code, willfully subscribes as true any material matter which he does not believe to be true; is guilty of perjury and shall, except as otherwise expressly provided by law, be fined under this title or imprisoned not more than five years, or both. This section is applicable whether the statement or subscription is made within or without the United States."

The USJF analysis said: "Mr. Obama has taken the oath of office of POTUS, in front of Chief Justice of the U.S. Supreme Court, John Roberts, in which he promises to 'defend the Constitution'. As an illegal alien, or even a non-natural born citizen, he would be acting as an ineligible president. Furthermore, as an attorney, and a former professor of constitutional law, Barack Obama would have full knowledge of the requirements for an eligible candidate for the office of POTUS. This shows that he has willfully stated that he will and is acting contrary to his presidential oath."
The USJF document showed that all of the charges require a specific intent.
"Mr. Obama knows, or at least should know, the place of his birth and the status of his citizenship, as all, or nearly all, adults in the world do. He has, therefore, willfully and knowingly made repeated false claims as to his citizenship, and this makes him absolutely liable for the above mentioned crimes," the analysis said.
The organization's earlier research, now included in its appeal documentation, found that in 1968, the Peace and Freedom Party submitted the name of Eldridge Cleaver as a qualified candidate for president of the United States.
The then-California Secretary of State, Frank Jordan, found that, according to Mr. Cleaver's birth certificate, he was only 34 years old, one year shy of the 35 years of age needed to be on the ballot as a candidate for president. Jordan, using his administrative powers, threw him off the ballot.
The other is a court precedent in which the governor of North Dakota was removed from office after the state Supreme Court determined he did not meet the state constitution's eligibility requirements.
"Even though Obama was elected to this office, this ineligibility constitutes a legal disability for the office of president of the United States," the USJF brief states. "In 'State ex rel. Sathre v. Moodie,' after Thomas H. Moodie was duly elected to the office of governor of the state of North Dakota, it was discovered that Thomas H. Moodie was not eligible for the position of governor, as he had not resided in the state for a requisite five years before running for office, and, because of that ineligibility, he was removed from office and replaced by the lieutenant governor," the brief explains.
North Dakota's historical archives document the case.
The Democrat was nominated by his party for governor in 1934 and beat his Republican opponent, Lydia Langer.
"As soon as the election was over, there was talk of impeachment, but no charges were filed," the state's archives report. "After Moodie's inauguration on January 7, 1935, it was revealed that he had voted in a 1932 municipal election in Minnesota. In order to be eligible for governor, an individual has to have lived in the state for five consecutive years before the election. The State Supreme Court determined that Governor Moodie was ineligible to serve, and he was removed from office on February 16, 1935," the state reports.
The president's lawyers in many of the cases have said, and judges have agreed so far, that the courts simply don't have jurisdiction over a question of eligibility because of the Constitution's provision that president's must be removed by impeachment, which rests with Congress.
In one case, the president's lawyers prominently argued, "The Constitution's commitment to the Electoral College of the responsibility to select the president includes the authority to decide whether a presidential candidate is qualified for office.
"The examination of a candidate's qualifications is an integral component of the electors' decision-making process. The Constitution also provides that, after the Electoral College has voted, further review of a presidential candidate's eligibility for office, to the extent such review is required, rests with Congress," the president's lawyers argued.
WND has reported on the multiple legal cases challenging Obama's eligibility in addition to efforts to raise the question at the state and national levels.
Several state legislatures are working on proposals that would require presidential candidates to submit proof of their eligibility. And a similar proposal has been introduced in Congress by Rep. Bill Posey, R-Fla.
The claims are that Obama does not meet the U.S. Constitution's requirement that a president be a "natural born citizen." The lawsuits have asserted he either was not born in Hawaii as he claims or was a dual citizen because of his father's British citizenship at the time of his birth.
The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."
However, none of the cases filed to date has been successful in reaching the plateau of legal discovery, so that information about Obama's birth could be obtained.
The White House has not replied to numerous requests for comment.
Besides Obama's actual birth documentation, the still-concealed documentation for him includes kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, his files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records, and his adoption records.
Another significant factor is the estimated $1.7 million Obama has spent on court cases to prevent any of the documentation of his life to be revealed to the public.

Because of the dearth of information about Obama's eligibility, WND founder Joseph Farah has launched a campaign to raise contributions to post billboards asking a simple question: "Where's the birth certificate?"
The campaign followed a petition that has collected more than 490,000 signatures demanding proof of his eligibility, the availability of yard signs raising the question and the production of permanent, detachable magnetic bumper stickers asking the question.
The "certification of live birth" posted online and widely touted as "Obama's birth certificate" does not in any way prove he was born in Hawaii, since the same "short-form" document is easily obtainable for children not born in Hawaii. The true "long-form" birth certificate – which includes information such as the name of the birth hospital and attending physician – is the only document that can prove Obama was born in Hawaii, but to date he has not permitted its release for public or press scrutiny.
Oddly, though congressional hearings were held to determine whether Sen. John McCain was constitutionally eligible to be president as a "natural born citizen," no controlling legal authority ever sought to verify Obama's claim to a Hawaiian birth.

TIM KINLEY IS IN JAIL FOR BEING A CHRISTIAN ???
History: Tim married in his church. He adopts her out-of-wedlock child and they have two children of their own. Tim's wife decides she wants another man. She takes the children and leaves. She files for divorce. She shows up at church with her boyfriend and the children. Tim speaks to the pastor, saying she can't attend church with her boyfriend and tries to get marriage counseling.

Instead of marriage counseling, wife gets a restraining order against Tim, gets the judge to sign an order that Tim is not allowed to teach the children Bible lessons and Tim has to take a psychiatric exam.

Tim has never beaten his children or wife.
Tim "passed" the psychiatric exam.
Tim has never been found in court to be an "unfit" parent.
Tim is a member of the Baptist church.
Tim's wife has refused to allow Tim to see his children.

After YEARS, and tons of money, Tim Kinley finally got the Court of Appeals to overturn the judge's order that he could not teach his children Bible lessons.

He is broke.
He cannot pay child support.
He was put in jail because he is broke and cannot pay child support.

If he had not taught his children Bible lessons he would not have spent his time, money and energy getting the judge's order overturned.

He is in jail because he is a Christian.
He believes HE should have been given full custody of his children.
But he hasn't even been allowed to see his children, even with a court order that says he can. When he went to court to complain that he has been denied seeing his children, the judge ignored him.

Tim finally "won" in the Minnesota Court of Appeals and it was decided that the judge who ordered Tim not to teach his children Bible lessons violated Tim's constitutionally secured rights. Before AND after that decision, Tim's ex-wife has refused to allow Tim to see his children. AFTER Tim won in the appellate court, they went after him for being broke.

On Tuesday, February 16th, the judge that ordered the warrant for Tim Kinley's arrest will hear the motion to release Tim from jail.

We need EVERYONE that knows Tim, or that believes a FATHER has the RIGHT to parent his children COME TO THE HEARING.

NOTHING changes until WE make it change.
